TERMS AND CONDITIONS — Frank's Air Conditioning & Heating, Inc.

Please read these Terms and Conditions ("Terms", "Terms of Service") carefully before using any services provided by Frank's Air Conditioning & Heating, Inc. ("us", "we", or "our"), including our customer review and feedback text messaging program.

By agreeing to our services, verbally consenting to receive communications, or interacting with our mobile communication channels, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not participate in our text messaging program.

1. MOBILE MESSAGING PROGRAM & CUSTOMER REVIEWS
Frank's Air Conditioning & Heating, Inc. operates a dedicated mobile messaging program specifically designed to collect customer feedback and review requests following a completed service, repair, maintenance, or installation.

• Purpose of Program: Outgoing text messages are sent strictly to request voluntary customer feedback, satisfaction ratings, and links to leave online reviews.
• Dedicated Texting Number: All review-related text messages from our system will originate from our dedicated, outgoing SMS-only number: 928-723-3928. Please note that this number is an automated, outbound system line and does not accept incoming voice calls.

2. USER CONSENT & OPT-IN METHODS (TCPA COMPLIANCE)
We strictly adhere to the Telephone Consumer Protection Act (TCPA) and mobile carrier guidelines. We do not engage in unsolicited text messaging ("spam").

• Verbal Opt-In: Consent is collected in person by our field technicians. At the conclusion of a service visit, the technician will verbally ask if you would be willing to receive a one-time text message with a link to leave a review. By verbally responding "Yes" or otherwise providing affirmative consent, you authorize us to send a text message to the mobile number provided.
• No Mandate: Consent to receive text messages is completely voluntary and is not a condition of purchase, service execution, or any contract with us.

3. OPT-OUT & HELP INSTRUCTIONS
You maintain complete control over your mobile communications and can opt-out at any standard time.

• How to Opt-Out: To stop receiving text messages from Frank's Air Conditioning & Heating, Inc., reply "STOP" to any mobile message you receive from us. You may also opt-out by emailing your request to frank@yumaacrepair.com.
• Confirmation: Upon sending "STOP", you will receive a single, automated text message confirming that you have been unsubscribed. No further review requests or text messages will be sent to your mobile number unless you explicitly re-initiate consent.
• How to Get Help: For assistance, reply "HELP" to any message, or contact our customer support team directly at frank@yumaacrepair.com or by calling our office at (928) 783-3648.

4. MESSAGE FREQUENCY AND FEES
• Message Frequency: This is not a subscription service. Customers will typically receive only one (1) review request text message per completed service visit.
• Msg & Data Rates: Standard message and data rates may apply to any text message sent or received in connection with our services. These charges are billed by, and payable to, your mobile service provider. Frank's Air Conditioning & Heating, Inc. is not responsible for any text messaging or data charges incurred.

5. CARRIER LIABILITY & SUPPORTED NETWORKS
• Supported Carriers: Our mobile program is compatible with all major United States mobile networks, including but not limited to AT&T, T-Mobile, Verizon, and regional carriers.
• Delivery Liability: Mobile carriers and Frank's Air Conditioning & Heating, Inc. are not liable for delayed or undelivered messages. Delivery is subject to the transmission capabilities and limitations of your wireless carrier.

6. PRIVACY & DATA PROTECTION
Your mobile phone number, opt-in status, and consent records are treated with the highest level of confidentiality.

• No Sharing of SMS Data: In accordance with carrier guidelines and our Privacy Policy, Frank's Air Conditioning & Heating, Inc. strictly prohibits the sharing, selling, renting, or trading of text messaging originator opt-in data and consent records with third parties, affiliates, or partners for marketing or promotional purposes.

7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Frank's Air Conditioning & Heating, Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your participation in, or inability to participate in, our mobile messaging program, including but not limited to delivery failures, network outages, or errors in transmission.

8. GOVERNING LAW
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

9. CHANGES TO THESE TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide updated terms on our website with a revised effective date.
